Tour nose-to-the- grindstone work is clear, thorough & right on point - uslike so much “anarchist” activity (or lack thereof.) Trace your intellectual history. What were your influences? How did you develop into such a whirlwind of anarchist instruction? 2 Answer: Personal experiences dealing with my life played a major role developing my aparchist instruction. When I got wrongfully convicted of all the charges in my arson case., being treated unfairiy, and then being abused here in prison, | just blew my top off. | was really pissed off about everything. Now. I just want to fuck over the svstem like it fucked over me. They call me “offender” but what about all the unpunished offenses they commit? You might hear promises made by judges, prosecutors, politicians. military personnel and other right wingers. Promises tumed to lies. Lies made into excuses. People are so blind to all of this. Thev're too busy working their slave job (or jobs) just trying to survive. People are so naive or unaware these days. They think things such as nothing bad could happen to them. Thev think the svstem isn't bad because they haven't experienced it or gone through 1t Then. the shit hits the fan. Judas kisses them on the cheek. It's like the movie The Matrix. Lawrence Fishbourne is right there telling vou all about the system. Which pill do you take? The red one or the hiue one? It's really eye-opening and scary. More people need to experience that. More people need to see how 1hey're being fucked over by our state and federal governments: how. thev're all in cahoots to keep ourselves below them { took the red pill. but I'm being heid captive. 1'm like their show display. Its like they like to brag, “Look at this. This is Eric. We fucked him over.” They want to add on to this collection because they get a sadistic pleasure off of it. They - the judicial system - hate that T voice my opinion and challenge them. In prison. | was searching for answers. 1 now hated the government. It betrayed me. Used me. | was their pawn and tov. Their scapegoat. | wrote a ot of letters seeking free books. | came #cross some catalogs and anarchy material. | read the material. Agreed with it. Connected to it emotionally. | bought some books chissecting anarchism. | was heavily influenced by Albert Meltzer. Sam Dolgoff and Michael Bakunin. They all died anarchists and were strong voices in anarchist history. [ was very sad that they were dead for a while. | won want them and their work to be forgotten. | wanted more prople (o know of anarchism, 0 | stasted writing my own literature And | was met with opposition by prison officials. This led to a high profile lawsuit. See: Smith v. Carrasco, 423 F Supp. 859 (N.D. ind. 2006) (A legal opinion you can get from your local law library). Then, I found you, Anthony, and the rest is history. People need to hear the truth about government. How it works. What it docs, etc. Only people like us can tell them. | keep plugging away because | care about everybody. | want to help. 1 don't want them to go through what I have. I'm not Christian, Wiccan actually, but here’s a good analogy from Matthew 20:26 of their Bible: If you want to be great, then you must be the servant of the rest. I want to be great, Anthony. That's one reason how | became this way. Question #2: Your case is very intercsting, yet basically unknown. Was your “crime” politically motivated? What were your motives, how did it play in the media and what have you been made to go through, since you've been in prison & why hasn’t the anarchist media taken up this case, as they've done with more prominent similar cases, out West for example? Answer: On August 29, 2001, | was found guilty of 9 counts of arson and 1 count of conspiracy to commit arson as a class B felony, after 9 hours of deliberation by a jury. On September 26, 2001 (two weeks after the September 1% terrorist attacks) | was sentenced solely by & judge (who used to be a state prosecutor) to a maximum term of 20 Years in prison, when probation could have been given. No one died or got hurt in the fire, and I had never been convicted of anything in my life. In fact, | was an active member of the U.S. Army Reserves and had a good life for a 22 -23 year old. I did not set the fire. 'm wholly innocent and | was railroaded because the arson was a high profile case in Indianapolis, Indiana. Yeah, 1 know what some people think: “Oh, everybody claims they're innocent!® But I truly am. 1 had alibi witnesses known by the court and my public defender but they never got to testify. And now, after all this time, | have evidence that supports the fire investigator and ‘my alleged co-conspirator committed perjury and presented false evidence at my trial, which was calculated to add credibility to my alleged co-conspirator’s testimony, who had given 3 different and inconsistent statements before trial. On February 23, 2001, 12 townhouse apartments were destroyed (see attached photographs). | became a suspect because the fire started on the back concrete porch of one of my ex-girlfriends and my car was seen by a sherifl’s deputy shortly before the fire by her ‘apartment building. The sheriff recorded my plate number after talking to the driver of my vehicle - the alleged co-conspirator, who told the deputy that he was parked by the building because he was waiting on a friend. Because of this, I got a call from the 11 investigating detective. ‘The night of the fire, I had let my alleged co-conspirator borrow my car because he said he met some girls on the internet and that he was going to meet with them. It was a Friday night and he had me believing we could do some stuff with these girls, 80 let him borrow my car while I finished up a project for my car club. 1 told the detective this at an interview on the telephone, o was released. The detective got a statement from the alleged co- conspirator, who told him the same thing. The detective told him flulmmgh!'!minvnlved,thlll\nnotlwkifl‘l!lnyvfim time but that he was looking at 20 years. He then lets him go home. Well, the next day on March 1, 2001, the alleged co-conspirator goes back to the detective with his mother, and tells him that he knows something about the fire, but doean't want to get in trouble. The detective then promises that an attempt will be made to keep his case in juvenile court so he won't have to go to prison (he was 17 years old at the time. | was a manager at Wendy's restaurant when | met him in 1999, and we became friends.) With the made agreement, the alleged co-conspirator told the detective that he and I had planned our stories and that he was the driver while | was the one who set the fire. He claimed he didn’t see me with anything to set the fire with and that he thought that I ‘wasn't really going to do it. He said he didn't really know why I had set it, but that when he heard about it on the news, he got scared and thus, planned with me our *stories” in order to stay out of trouble. ‘The detective arrested him on juvenile charges and took him to Jjuvenile jail. Helhmmmelurm.lmngdmeund-dndmywn work without any arrest warrant. | stayed in jail because I couldn't make bond. 30 days later, the alleged co-conspirator was released into the custody of his parents. When the fire happened, nothing else newsworthy was going on, s0 when this all went down, the media jumped all over it. It was on television and in the newspaper. Everybody who I talked to knew about it. To make matters worse, the alleged co-conspirator got four people who I knew, and whom he was good friends with, to help him yunh:hhmemme.bywfirwuutlmldflmlmflwhhdmv 1was arrested. However, three of these witnesses testified that | dndn\mnlubnmlhebufldln‘dwnlnfl!h-lln'izdwpullheflm out. ‘The prosecutors believed this too, even though in my alleged co- conspirator’s third inconsistent statement, that he stated we agreed not to tell anyone about the fire. And now, he said he saw everything used in the fire and that we bought Duraflame fire logs at a Wal-Mart in Franklin, Indiana where I lived and that my motive for setting the fire was revenge for my ex-girlfriend not wanting 1o go back out with me. They all lied. s First, one of my alibis talked to all of these new witnesses and they told him they didn't know anything about the firc. Second, | told my public defender to get the records from the Wal-Mart to prove they were lying, but he wouldn't do it. The Duraflame logs were. never mentioned in the original fire report. Then, after the co- conspirator changed his story the third time and said that Duraflame logs were used, the fire investigator testified that he recovered Duraflame logs from the debris. He and the prosecutor then presented a photograph which supposedly showed a picture of a Duraflame log, but they did not produce the log in court nor did they ever forensically test it. | have now received information from Wal- Mart's legal department stating that no brand of such logs were sold by them on the date in question! The only evidence against me was the word of these people. There were no eyewitnesses, nor any physical or forensic evidencel Moreover, the alleged motive was contradicted by the ex-girlfriend herself at triall She testified that she had asked me out on Valentine's Day, but I rejected her, telling her we could be friends. She also testified that on her birthday, two days before the fire, | had sent her two birthday cardsl Now, why would I burn her apartment down? 1 had & new girlfriend ~ my alleged co-conspirator’s ex- girlfriend! So, we come to hjs motive. First, | believe he set this fire, maybe thinking that somehow I'd get blamed for it or that I'd go running back to my ex-girlfriend to support her - 80 he would be clear to get back with his ex-girlfriend, but his plans got messed up because the Deputy saw him there in my car. So now, he had to blame it on me to clear himself. Secondly, two weeks before the fire, he found out that me and his ex had had sex and this provoked a huge argument, which ended with me kicking him out of my house. He had been living with me at the time. It wasn't as if I had betrayed him by going out with his ex because they had only dated and from what | knew, they didn't even have sex. She called me and asked me out and | told him. He said he didn't care, that it wasn't serious and to go ahcad and go out with her. Soldid.” We fell in love and he flipped out. While [ was in jail, he kept calling her, trying to get back together with her. ‘The other witnesses had beefs with me, too. [ had dated their ex- girlfriends and they were all addicted to drugs. While [ was in they stole some of my property. When I found out about it, one of them told my witnesses that she was gonna do whatever she could to keep me in jail because she said I could have all the property. She then punched holes in my bedroom walls to send me a message. At trial, all their testimony conflicted in most respects. 1 couldn't believe I was found guilty ~ especially after the foreman of the jury dropped his jaw in disbelief after hearing such conflicting testimony about where | was at and what | allegedly said. | mean, I looked right into his eyes and I'm sure he was on the same page as me. ¢ The reason [ was convicted was because my attorney didn't investigate my claims, didn't present a complete defense and didn't argue my case well enough. To add salt to the wound, some of these witnesses | had a beef with, came to my sentencing, laughing as | wept in tears, wearing my clothing. I got the maximum 20 year sentence. My alleged co-conspirator received nothing and has been free ever since. Since my conviction, I've been trying to get a new trial, but I believe that there is a conspiracy against me. Because I'm representing myself, the courts are abusing their discretion in the guise of justice in order to deny me relief. They are not taking my claims seriously. It doesn't surprise me, though. ‘The state is oppressive. It needs prisons to create jobs and to Pperpetuate the existence of its members, loyal to it. Why would they grant me relief? I'm by myself. No one supports me. I have no living family. What would the judicial system look like if they granted me a new trial - especially after what they did to me? Why, so I could sue them for millions of dollars in a wrongful conviction lawsuit? So [ could show the media how dirty its prosecutors are by submitting false evidence? Do any of you think they want this kind of media? That's why I'm being denied relief. Even in prison, the prison officials keep me from submitting my evidence to the media and they will not let me show this evidence fo the members of my jury, even though | have their mailing addresseal All the guards and prison officials know about my case and some. have used my case to retaliate against me. For example, while at the Westville Control Unit, 1 made some complaints about the counselor. He found out about them. He threatened me by stating he'd give me & new reason to hate the dates associated with my arson case. So, on February 23, 2005, he falsified a disciplinary report, alleging that | had abused the outgoing mail procedures. (February 23 is the same day the fire occurred.) ‘Then, on March 1, 2005, I went to the disciplinary hearing, where the guards violated my hearing rights - and then beat me up, breaking my nose. (March 1+ is the day I got arrested for the arson.) 1 don't know why anarchist groups have not tried to help me. I've written to Clack Cross, Fifth Estate, Break the Chains and the Anarcho-Syndicalist Review, but I've never received any word back. The prison very well may not be mailing my letters out. They do that alot in here. | wish someone would help, though, because [ desperately need it. | am a comrade whose life has been taken away and I'm being physically and mentally tortured in prison. My losses and suffering have been great. | would do anything for the help. Question #3: Indiana is & bulwark of Amerikan fascism. It's the birthplace of Eugenics and has always been a strong base for the Klan and other rightwing groups. Can you give us a brief history of these politics and how it translates into law and the prisons? Answer: In the 1930's and 40's the Klan was HUGE in Indiana. Growing up, I never saw any Klan rallies. It seems that they have segregated themselves from the groups of people that they dont want to be around. Believe it or not, I see more racism coming from black people than I do white. Ive even heard that they get with white women so they can destroy the white race. Crazy stuff. You're more likely to run into a skin or neo-nazi here in Indiana than an actual Klan member. Klan propaganda is still strong, though. You still hear a lot of racist Klan jokes. You see a lot of rebel flags - Confederate flags from the Civil War, but you seriously don't see too many Klan movements. To be honest, Ive never seen any Klan rallies or town gatherings. 1ve just heard about a few ‘meaningless ones. From the Klan guys [ know of here in prison, the Klan has grown into this quiet, secret society; like an elite special forces group. Everybody knows the name, but never knows what's going on with them. In my opinion, any member of a right wing group might as well be a fascist, but the problem with that is that they all are trying to be the absolute rulers over a society, 5o they can't be a fascist. These right wing members in Indiana are very similar to Benito Mussoli logic, and practice his idea and doctrines of the state: “Everything for the State; nothing outside the State; nothing against the State.” In politics, Republicans run the show here in Indiana, but I have o knowledge of the Klan or such other groups using their politics to influence the law and prison environments. They can't have too ‘much of an influence because | remember this high profile case in Martinsville, Indiana where a high-ranking Klan member was found guilty of murdering this black girl almost 20 or 30 years ago, and Martinsville is the biggest Klan town I know of. It seems to me that the right wing believes it is superior to all; therefore, anything not associated or belonging to it is to be manipulated, treated unfairly and simply used in order to perpetuate the right wing. 1 think race issues are a distraction about the real problems with government, which is class struggle. It's about the rich and the poor. The rich use their resources, authority and influence to create the society that fits their beliefs. They do this by passing laws. The poor are too busy trying to survive, 80 that by the time they learn of these Iaws, they're already being punished for violating them. They vote for each other in local elections, 5o they can manipulate laws through the “good ‘0l boy” system. This is Indiana politics: all for us and for no one else. It's the opposite doctrine of the Three Musketeers! ¢ Question #4: Are you from Indiana? Where did you grow up? What was it like in your family, neighborhood, community and surrounding towns? This would be the 1980’s, I believe. Answer: Yes, I'm from Indiana. 1 had a very rough and difficult childhood. My father died in a car accident in 1980 when I was only two. My mom re-married and I got adopted. That's how I got the last name “Smith” but I plan on changing it back to my father’s last name Danachi, which is Italian. It's pronounced “Dah-nah-key.” My mom’s marriage didn't last long, so she divorced and raised me in an apartment in Greenwood, Indiana. She developed breast cancer and because of the bills, we had to live off of welfare. Without a father figure, | was a mean kid at times. | was fearless. and 1 liked to fight the bigger kids. 1 was rotten to my mother, which 1 regret, but I dont know why [ was so mean. I was o bad that my mom asked her step-brother to take care of me. My mother later died in May of 1986. 1 was only eight-years old. So, my step-uncle raised me for a while. He, however, divorced his wife and she became my new “mother.” She was very strict and believed in beatings as punishment. I'm talking about chokings, slappings to the face, paddles to the rear, switches to the rear and legs - all kinds of crazy shitl Everywhere | lived, and I moved four different times before I graduated high school, I lived in all white communities. My elementary schools were a part of the Indianapolis public school system, 5o black kids were bussed in from four miles away to attend our schools. This didn't bother me. | had a lot of black friends in elementary school. In fact, my best friend, Antoine Mitchell, from elementary school was black. After sixth grade, I moved to the country - Nineveh, Indiana, which is 12 miles northeast of Nashville, Indiana. We had a lot of land. Since second grade, I always participated in organized football programs. | was always the starting running back. I was a fast white kid. More lightning quick than fast, though. People always had a hard time taking me down because 1 could cut on a dime, spin off them, and was just so clusive. | was short too, so | was hard to see. behind the offensive line. 1loved Brown County. There, I was a high school football star. My sophomore year, our school went to the football sectional championships. It was a muddy and rainy game. | sprained my ankle in the 3 quarter and we lost 14 - 12.” We should have won but our kicker missed a point-after-touchdown attempt, so when we scored the would-be tying touchdown, we had to attempt a two-point conversion. Our quarterback got sacked by a saiety blitz. It was devastating. In school, I was a class clown. 1 didnt take school work too seriously. 1 didn't care about grades as long as [ passed. I could have applied myself better, but I had a lot of 1was being abused by my so-called new “Mother.” She was crazy, man. Abusive and nutty as the late movie star, Joan Crawford, who abused her adopted daughter, Christina - you know, *Mommie Dearest™? | swear she was just like Joan Crawford, except more stronger and bigger - like a female bouncer. 1was really scared of her and afraid to do anything because her son, who was about six years older than me, was huge. He used to be the starting quarterback for Decatur Central High School. He was about 62" and weighed around 215 Ibs. All muscle, t0o. His punches were like a mule kick! He hit hard. ‘Aside from the abuse, my childhood was okay. 1 played outside in the yard a lot and grew up listening to rock and heavy metal. Some punk, too. Billy Idol and AC / DC were my favorites. I liked Twisted Sister, London, WASP, Pantera, Metallica, Mega Death - a shitload of bands. I'd jam to ‘em all day long. 1 always wanted to learn how to play an instrument, like the electric guitar or bass, but we didn't have the money to buy one or to take the lessons. After my sophomore year, | ran away from home after my step- mother had choked me silly and abused me. A friend and his parents hid me, and reported the abuse to the authorities. | stayed in a foster home for a couple of months until my grandfather decided to take me in. 1 moved to Beech Grove, Indiana - a white suburban area southeast of Indianapolis. Starting school there was hard. Making new friends sucked and | still struggled academically. 1 still played sports and hung out in ‘popular crowds at school, but I still felt like an outsider. I had no direction. To make matters more stressful, my former Brown County High School football team won their first sectional championship in school history and I couldn't be there for that special moment. | had a ot of close friends at Brown County and everyone was shocked that I was gone. They were double-shocked when they learned why. My junior year, I signed up with the U.S. Army Reserves under their delayed entry program. Even though | was barely passing high school with a D+ average, I still needed college money. I planned on getting a degree. After I graduated in 1997, I went off for Army twaining in the summer, and when I got back in October, I moved to Franklin, Indiana. started to attend Ivy Tech Community College in Indianapolis as a part-time student. The weird thing is that in college, my grades were good. | was acing the business classes and walked away with an overall b- average. I quit college though, because of a girl I thought | would marry. We got a house together. We didn't work out as | thought. so I broke up our relationship. The lo Question #5: It's so refreshing to read your work because it is written 8o clearly and usably, unlike so much “anarchist” writing we run across. It's obvious that you are a clear thinker who has developed a logical writing style that can really help others wade through the legalese jungle of confusion the system throws at prisoners who attempt to challenge infustice. How did you develop at such a writer? Answer: Ive always liked writing. When | was in elementary school I wanted to be a writer. | guess I became good at writing by copving the styles of various writers. I'd think through what | wanted to write about, make rough drafts, and then draw up the final versions. Being a good writer comes easier if you know how to proofread, edit, and if you can keep an impartial mind. Getting your hands on writing books, helps too. Being a good speller and knowing the rules of punctuation is really valuable. 1'd recommend everyone getting Mitchel Ivers' Guide to Good Writing (Random House) (1991). It's a great self-help and how-to book. Anyone who reads it seriously will become a much better writer. As far as legal writing goes, I learned hands-on. 1 studied self- help legal books and learned the styles of the State’s Attorney General's office. Making legal arguments are like writing essays - you argue two sides and explain why your side outweighs the other. Overall, maybe my writing skillsa come from my education? In high school, I was in Honors English and Year Book classes. In college, I took more English. 1 even took a journalism class in high school, which was fun. 1 loved to write, but reading!? God, I hated reading! My teacher would pick out the most boring books! That was one of my downfalls in high school. 1 struggled because there was too much reading. Question #6: I'd like to hear your honest assessment of the support you've had (or have tried to generate.) What is the problem with anarchists who claim to do this or that but actually do nothing, nor explain their malfeasance? What about other forms of support from other groups, family members and friends? Answer: I've tried to obtain support from many people to help me fight my ‘arson conviction and treatment in prison, but [ve never been lent any. Ive written more than several private attorneys. law schools, and civil rights groups, but they all write back requesting money | don't have. They state that they can't take my case because of lack of time and current case load or they simply don't represent prisoners. My best friend’s mother, who knows of my innocence, sent out a couple of emails to prisoner support groups, but they couldn't help, cither. She wanted to start a website, but doesn't know how t start one. Now, she is discouraged, and has given up. Hell, Ive even tried 1o write the jury members from my arson case (1 have their mailing addresses), but dig this: the prison confiscated them, stating| /] cannot write to them! These letters explained the relevance of my ‘missing evidence, etc. IVe written a few anarchist groups like Break the Chains, the Fifth Estate and Anarcho-Syndicalist Review for help, but they never respond. To be honest, I don't even know if they ever received them because the prison officials read all outgoing mail and throw mail away. I don't know what the exact problem of such groups are. I believe they all mean well, but that there are just too many people to help. The system is really dirty. A lot of innocent people are locked up and there are a lot of guilty ones that don't need to be behind burs. Id say the contributing downfalls with these groups are poor communication, lack of adequate resources, and that they do not possess the knowledge to use their resources to their advantage. Everybody talks, but they come up short when it's time to act. It makes us feel bad, to, because there is nothing worse than to experience a false hope. People like me have little or no family and friends. That's why a lot of us rot in here. We need voices. Question #7: You've been courageous in the face of these brutes, challenging them every step of the way. Tell us how your captors “argue.” In other words, document the asssults & penalties you've endured, why they occurred & what their “logic” was. Answer: You know how the government keeps lists of people they watch, hate, etc.? Well, with all the legal work I've done while in prison, | have definitely gotten the attention of state officials. This is obvious because | am being abused and treated differently than other similarly-situated prisoners, and the differential treatment did not start until after [ started to question their authority in court. That's one way that they argue. Here at the Indiana State Prison, back in October 2002, is the first time I was assaulted by guards in retaliation for a conditions of confinement and denial of court access lawsuit | had in state court. One of the defendants who | was suing, paid 4 gang members to force me to hide a package in my cell. These thugs had knives t0o, so | had to accept the package. I'm not Bruce Lee, you know. 'z Well, right after that, some guards came to my cell, searched it and found the package. They took off with it and I later received a disciplinary report. They said the package had two knives in it and a set of postal scales. In the meantime, I was taken to a “Special Management Cell” (a small suicide tank made of steel, no windows, just a bed, sink and toilet combination, and a camera in the ceiling watching your every move. You're also locked in behind a solid steel door) ‘The “special” cell is used as a device of torture. There, you are not allowed any property, medication or commissary. You are also deprived of adequate meals, only being delivered a sack meal and either an apple or an orange. You have to wear a reed jumpsuit and the air conditioning stays on during the winter. On the way up there (being handeuffed behind my back) a correctional lieutenant and two other officers slammed my face into an clevator wall, telling me to dismiss my lawsuits or worse would happen. To conceal my facial injury, the prison officials cancelled my visits and would ot let my visitor see me. Four months later, after being found guilty of the disciplinary report, | was in segregation. Two officers there said | threw “unknowm liquids™ on them (which I didn't) I was taken again to the Special Management cell, but on the way up, two other officers slammed me into a wall, threatening me to dismiss my lawsuits ‘because they were ‘old school” and that they knew how to hurt you without leaving marks. | was later transferred to Westville and was sent to the Westville Control Unit on April 12, 2004, ‘The Westville Control Unit (it has gone by other names in the past) opened in the spring of 1991, and it is used to house predators, dangerous gang members and other prisoners who pose a threat to the safety of others. Today, however, prison officials also use units like this to retaliate against prisoners like me. They do this because You are severely restricted in your ability to possess clothing and other property. You are isolated by yourself in an enclosed cell for 23-24 hours a day, and only get to shower 3 times a week. You never Ret to go outside, and now, there is no group recreation. All meals are delivered to your cell and you are handecuffed behind your back, sometimes with ankle shackles, everywhere you go. If you would like to know more about this place, contact the Human Rights Watch Group and ask for their report that they conducted in 1997 entitled: “Cold storage — Super Maximum Confinement in Indiana.” (This place became famous nationwide when a prisoner there cut off his finger and sent it to his attorney to report abuse.) The following is a brief listing of the abuses I endured there - aside from the punitive restrictions: June 18, 2004. Prisoners were flooding their cells because the guards would not feed us tunch. 1 kicked on my door to notify the guards that I needed a mop. The guards refused and told their |3 ‘superiors (who { had filed grievances against in the past) and the superiors demanded my shoes so they could see me walk barefoot in dirty toilet water. I refused and lay down on my bed. They responded by making me and then, when I tumed on my stomach, they shot me seventeen times with a pepper ball gun. June 23, 2005. Prison officials refused to copy legal papers concerning an appeal to my arson case where I had a set deadline to Jile._In protest, I climbed up on the down stair’s recreation wall, 20 feet up in the air and made a hammock by tying a bed sheet to some sprinkler pipes. I refused to come down until my copies were made. The guards responded by making me with 5 cans of mace and shot me about 40 times with pepper bal guns, blinding me temporarily and ‘having no regard if I would full to the concrete floor. Iwas taken to the hospital, and 1 later got my copies. March 1, 2005. A prison official conspired with 3 other guards to retaliate against me for filing grievances against them. These guards Leat me up, dragged me across the floor and broke my nose. | wasn't doing anything wrong, and 1 was handcuffed behind my back, in ankle ‘shackles and connected to a lead rope. By the way, I'm only 5'4", 135 Ibs. Iwas taken to a hospital. January 5, 2006. Three guards on night shift maced me after I responded to their siander against me. They maced me in my cell for an hour straight, then locked me in a shower about the size of a small walk-in closet, and sprayed me full blast with a fire hose. They then destroyed the property in my cell. April 10, 2007. When Iwas transferred back to Westuille for the ‘second tune (which the transfer out from the first was calculated to escape jurisdiction of the court concerning one of my lawsuits), a guard who didn*t get along with and had filed grievances on, maced me while I was at recreation. I had done nothing wrong and when I asked for his superior, the superior came and ordered me to cuff up. Concerned for my safety, I refused. 1was shot 40 times in the bare back with the pepper ball gun and maced with a can or two of mace. The incidents of excessive force occurring on June 18, 2004, June 23, 2005, and April 10, 2007 were tape recorded. The logic of doing all these things was to gain « sadistic pleasure in the guise of safety and security concerns. Regardless, the amount of force that was used was t00 excessive and not necessary because there existed either other options to serve these interests. For example, they simply could have cell extracted me, waited me out, left ‘me alone or utilized the disciplinary system by writing reports for any alleged rule violations. When 1 first learned how to file lawsuits, I filed all kinds of them in state and federal courts, and eventually 1 obtained what the courts call “three strikes" meaning, I had 3 or more lawsuits dismissed /& because they were allegedly “frivolous” or that they failed to state a claim upon which relief could be granted. When this happens, the courts sanction you. Thanks to Congress and state lawmakers, they created laws stating that if you cannot afford to pay a filing fee you cannot file another lawsuit unless you are in danger of serious bodily injury, such as a loss of a limb - or death. So what this does is that it gives prison officials a license to torture you and destroy your property, because such things do not amount to a danger of serious bodily injury! The prison officials know this, 30 they abuse me. For now, there is nothing I can do, cither. 1have Indiana’s three-strike law challenged in the Indiana Supreme Court, arguing it is unconstitutional, but no decision has been reached. I'm confident that I'l win this case. It was a high profile case and was on the news (there | was again) and a bunch of legal organizations filed briefs either in support or against the law. Indiana laws and the state judicial system are really bad and corrupt and the people (or prisoners) have very few rights to seck relief. For example, there are o laws that grant a right to sue for violations of certain statutes, and there is no state remedy to sue for damages for violations of the state constitution. The Republicans in Indiana are to blame for this because they dominate Indiana politics. Republicans feel that the People have no rights other than what's given in the federal U.S. Constitution. That's why they don't make any other laws to help the people concerning their legal rights. The result? Meaningless laws, made to make the system look good, that the government does not have to obev. The end result is arbitrary government action. Question #8: You've also been bounced around from one gulag to another, with various levels of “security.” Can you tell us what ach of these prisons was like, how they are different? We all know their goal is to break prisoners and reduce them to states of hopelessness &/or madness. How does a prisoner maintain their sense of self, let alone move forward, doing productive ‘work? Answer: Yeah, I've been bounced around. I feel like I'm in pinball machine, and 'm getting lit up (bong! bong! bong-bong-bong!) (laughter). Since I've been in the custody of the Department of Corruption, I've heen transferred EIGHT different times! There is new system on how they classify the security level of a prison, now. The old system used a 1-5 number system. Level 1 prisons were places like a work-release facility, where prisoners have it made in the shade lnd level 5 were the supermaxes. Every prison that had a wall around it was meant for violent prisoners (or those wrongfully convicted of such crimes) -places like the Indiana Reformatory in Pendleton, Indiana and the Indiana State Prison, located in Michigan City. Now however, they just have a system using number 1-3. I'm not exactly sure why they changed it. Rumor has it that they changed the system to get special federal benefits and monetary awards and they changed the system to manipulate federal law. They wanted to ‘menipulate it so they don't have to give prisoners the rights they arc entitled to. 1 don't know, but I believe it wasn't for anything beneficial to prisoners. 1 started my prison sentence at the Reception Diagnostic Center (*ROC") in Plainficld, Indiana. This is the place where everyone convicted of a crime and sentenced to DOC time, starts at. It's like the Indiana State Prison and Westville Control Unit put together: you're either celled two deep in a pod area, where each section has about twenty cells, three tiers each, forming a flattened c-shape. ‘These pods represent the “new” parts of ROC. Elsewhere, are barred cells located on ranges. These areas are truly hell-in-the-cell, because there’s no air-conditioning and you're stuck with a cellmate. ‘The officers are militant. It's like they are all fresh out of DOC training. Yelling, walking around with their shoulders back - that type of shit. You are stuck in your cell 23-24 hours a day unless you are going to recreation, chow or on pass. It's really a confusing time for beginners. Stressful for all. It's process we all must endure and the prison staff makes a calculated determination on which of the 30 prisons in Indiana you'll go to. This is done by an awarded point system. You get points for various reasons: length of time, past criminal record, etc. The more points. you have, the higher your “security level” will be. The higher the level, the more punitive and dangerous your prison will be. 1 was a level 2 prisoner, and got sent to the Westville Correctional Facility (the Westville Control Unit is on the same grounds, but separate from the facility where the general population resides.) ‘The Westville Correctional Facility is up far northwest of Indiana, out in the middle of a small nothing town. It's a 30 minute drive from the Indiana State Prison. Upon arrival, the view is very intimidating and shocking. About 30 guard towers surround the whole facility. Outside them are rows of razor-wire and now, all electric fences (too many escapes.) The buildings are old-looking, no higher than two stories, unless they are special buildings like the Health Care Building or Pre-Release honor dorms. There's a lot of *set-tripping” here. A lot of young and uneducated “gangsters.” There's a lot of stealing and fighting because of race. There's some good too, but to get by peacefully in order to bit, you need to clique up with a few people, and stick with them. The rules are petty and it's not a place you want to be if you have ten years or more to do. A lot of prisoners are rebellious and hostile towards the officers, but a lot of us end up losing earned credit time, and get transferred to higher level security prisons as a result. A lotof /b prisoners get forced and coerced by prison staff into slave kitchen jobs, which is no fun at all. This happens even if you are trving to get into educational programs. From Westville, | got sent to the Indiana State Prison - the most dangerous prison in the state! There are about 30 foot tall walls surrounding the prison. Razor wire is fitted over the top, with guard towers and light towers. It's huge, and it is very old. A lot of the buildings were erected in the very early 1900's. The prison is very worn out and dirty. Barred cells, like you see on television and there’s a darkness to everything. You have to be careful in here because if you get into a serious fight, no guards can Tun to your aid because you're locked down a long range measuring about 100 fect. Thirty-three cells and a shower unit are located on each 5-story tier. ‘The place is big, and the prison has a hard time providing clothing, sanitation and hygiene. As a result, you see a lot of bearded prisoners with long hair, wearing used clothing (even underwear) and there is a lot of stealing.” Your only prayer to surviving is to clique up with a few good guys and keep to yourself. If you have money, you can get whatever you want, even a piece of ass from a nurse of female guard. The more money you have, the more enjoyabie your stay will be. Just watch over your shoulder. Pendleton Correctional Facility is a little better than the Indiana State Prison as far s cleanliness and sanitation. That's due in part because a lot of the prison has been remodeled. The officers there are abusive, racist, and petty. It gets tiring having to bite your tongue all the time. There’s a lot of gang-related activity there, too. A ot of drugs. The New Castle Correctional Facility located in New Castle, Indiana (fun town by the way) is operated by the Geo Group, Inc. The DOC gave them a 10-year contract in 2006. Geo Group's website (- st o) under New Castle Correctional Facility proudly states that it “provides secure care, custody, and control for Indiana Department of Correction offenders.” During that year, a prisoner was murdered, another had an outsider forge release papers by pretending to be a cop, and actually g0t released and CNN reported a full-blown prison riot where fires were set and graffiti written outside the buildings, reading “Naptown” and “Arizona.” The prison rules are petty, but at least everything is “securely cared and controlled.” " The Westville Control Unit hold around 250 prisoners. It is a place of physical and mental torture. Unnecessary restrictions on property, clothing and food are enforced. A lot of prisoners have pending lawsuits for abuse by staff. The abuse was so bad, that video cameras were installed in the summer of 2007. Here, you're trapped behind a solid steel door for 24 hours by ‘yourself, unless you go to what they call “recreation” which consists of little or no physical activity. The place is air-conditioned and its design came from Pelican Bay's Supermax in California. Everything is controlled. ‘The place is constructed with only blocks, steel frames and lexan It is hard time here. A lot of people go insane here. On August 18, 2007, a prisoner hung himself there. The place is energy-drainin Food items are reduced as unofficial punishment. A lot of prisoners lose significant weight and muscle mass. It makes you violent and wants to make you snap. A lot of people do time their own way. There’s really no set ‘standard on how to do time. A lot of people maintain their sense of self by listening Lo music. Some get into religion. There’s a famous saying: Expect the worse, and hope for the best. If you think about it that way, time will be less disappointing. Most times, however, we have to create our own avenues to escape. It's hard because not only do we suffer, but our family and friends sufer, too. Society should really be concerned about the animals they are creating in here and they should press for alternatives to incarceration. The judicial system is designed to convict and punish, regardless of innocence. This is true because the system is based on opinions and prejudice. What happened to me and other innocent people that have been wrongfully convicted, can happen to anybods. Question #9: 1 know several conscious prisoners encaged in Indiana. Give us & rundown on the various progressive & revolutionary ideologies amongst prisoners, as well as the conservative, reactionary and fascist ones. How do we help prisoners transcend their (un) revolutionary suicide lifestyle (gangsterism) to one where they become willing to take the biggost gamble of their lives - to actualize themselves as a full human being, work to realize their innate talent, attain genuine education & self-respect & do right by others. And, if they do manage to attain this flowering of their humanity, undes such horrific conditions, how will they instill this into their peeps in the ‘hood, which are merely more open-aired hostile environments? Answer: Unfortunately, the majority of the prisoners here in Indiana are not revolutionary. They are institutionalized, and they would rather fight and steal from each other than challenge the institution's rules. Alot of us simply say, “Why fight? We cannot win!" Thi their mentality. They are discouraged easily. i It's really frustrating, too. 1 don't think there is any way to transcend their current self to a real and full human being. Their “gangsterism” is too computed into their head. It gives them a sense of power and feeling of belongingness and protection, much of which a lot of them never had before their incarceration. The ones that do change and try to make a difference are few in number. On the other hand, maybe these men and women feel that they deserve to be this way and are content with who they are because they were guilty of committing crimes? Maybe prison is all they have to survive? More than likely, it would take credible voices - people out on the streets - to come into the prisons and meet with the prisons to instill life-changing inspirations in them. You work with the zines helps, but it would take more because prison officials sometimes confiscate them or prisoners just don't know about your distributing center. A lot of prisoners can't even read well. In here, us “conscious™ prisoners have to walk a fine line. What we say may offend other prisoners. Hell, they might even snitch on us! Trust is a bug issue. First, we have to gain that trust, then we have to gain their respect. Only then can we try to attempt to make a change in their life. But all of this is easier said than done. Focusing on what makes a “hood” a hood can bring a community together. Neighborhood programs, youth athletic programs and community projects can be the only way to bring peace to a neighborhood, so hostile. Knowing that the hood” isn't the only ‘opportunity in life - that it's the government who wants them to kill and destroy each other and themselves, can bring a community together. 1 would love to start a volunteer project where we could change the physical appearance of poor communities, and make such areas self-sufficient. I'd like to do some painting, re-modeling homes, installing sofar panels and windmills for electric energy so no one has to pay these capitalist pigs money for heat, etc. This way everyone could be warm in the winter and cool in the summer. Things like this. Knowledge is the key, though. A lot of these “gangsters™ could help their members in the hood by becoming familiar with governmental programs and laws. Having good credit can help people get jobs and loans. Anyone can clean their credit up, | § themselves. Although, it might take some time, it can usually be done within six months. All you need to do is contact cach credit bureau (Experian, TransUnion and Equifax) and tell them you need a free copy of your credit report cither because you are seeking employment or you believe you're entitled to a frec copy because you believe you've been a victim of fraud (identity theft) Federal law requires these bureaus to mail you a free copy of your credit report. From there, look at all the adverse information. To erase this off of your credit report, simply contact each of the bureaus and dispute the adverse information, stating that you simply have no knowledge of these reports. By federal law, the credit bureaus must verify the information. A lot of the times it cannot verify the adverse information, this, federal law requires that the ‘adverse information must be deleted! Law schools, Ivy League type achools, stints in the military or the police, school administration, etc. these are the types of people who end up as Judges and prosecutors. Occasionally, you can convince a judge to rule according to the rules in your favor, but it almost invariably takes an incredible amount of time, money and effort, which they make it exceptionally difficult for poor people to ‘muster, much less prisoners, especially indigent ones. Prisoners do what they can from what I've seen. Many concentrate on studying the law, learning how to write writs and ‘mount procedural and court challenges. They try to solicit support from outside sympathizers by describing their situation, writing , - essays, drawing graphics, etc. 1don't know what all else prisoners can do - hunger strikes, other actions. There's no question many of you have been railroaded in the first place, have been set-up while in prison and so forth. It's an endless litany of abuse and the breaking of their own laws and rules by the authorities. They make everything be forcibly funneled through their corrupt game, where smarmy lawyers play their expensive roles - and they are just roles - they get paid for “expertly” lying! Judges and prosecutors have immunity, but defense attornevs dontl They have the whole weight and all the resources of the state, which is endless as they steal enormous amounts in taxes every single year, and the defense has nothing. They can threaten you with all these horrible outcomes — prison, probation, forced Iabor, fines, etc. if they “win" and you can do nothing to them if you “win” except eventually maybe procuring your “freedom” or winning judgment, which is 1o skin off their nose, nor will it adversely affect their carcer one jota. All the monies paid out are from stolen monies they lifted from (mostly) working people, anyway. When they spend too much, they cut vital services &/or raise taxes. So, they never “lose” even when they lose. They may lose the gravy from one previously held captive, but they are loathe and ever so reluctant to admit any ‘mistakes or release any captives “prematurely.” They are in the punishment industry business and most certainly it's corrupt as hell and they play favorites. The rich and even yuppies who commit a “crime” (drug use for example) first, aren't gone after. If (rarely) caught they're nat prosecuted, A “deal” is made, instead. Poor people without connections to make these “deals” get prosecuted and harshly sentenced, because like other capitalist ventures, it requires. constant expansion. As the government knows no other ‘argument” other than brute force, they lose the allegiance of the people. Without that, they can't command citizens to kill other citizens.
